U.S. District Judge Gerhard A. Gesell, in ruling upon Oliver North’s motion to dismiss the six criminal counts against him in the Iran-Contra case, has magnificently rejected North’s contentions that he had “an absolute right to lie,” destroy documents and obstruct investigators while he was a White House aide (Part I, Nov. 11). Judge Gesell further declared that the court would not give judicial approval to the suggestion that North was free to place his personal interests or objections to national policy ahead of the public trust he had accepted.
In the face of Judge Gesell’s ruling and comments, would President Reagan dare to pardon North? Certainly if he did so, the judge’s wisdom ought to apply to the President as well.
