LOCAL : Man Held in Rape of Child Faces New Counts

An unemployed construction worker accused of kidnaping and raping a Huntington Beach girl last month was charged today with another sexual assault stemming from the attempted rape of a Dana Point teen-ager.

Deputy Dist. Atty. Ariadne Symons said the second attack occurred Sept. 7, roughly 2 1/2 weeks before Kyle Joseph Borges was arrested on suspicion of abducting a 12-year-old from the living room of an exclusive Sea Cliff on the Greens condominium.

In the Dana Point incident, a man entered an unlocked window of a home in the 24000 block of De Leon Drive and went into the bedroom of a 14-year-old girl, said Lt. Richard Olson, an Orange County Sheriff’s Department spokesman. When attempts to muffle her screams failed and the girl’s mother woke, the man fled, Olson said.

Symons filed the new charges of burglary and attempted rape against Borges during his arraignment today before West Orange County Municipal Judge Alan D. McKone.

Borges, who is being held without bail in Orange County Jail, is accused of 11 felonies, including burglary, kidnap, rape, lewd and lascivious conduct with a minor and forceful sexual penetration by a foreign object. He also faces a misdemeanor count of prowling.

Borges pleaded innocent to the charges, and McKone scheduled a preliminary hearing for Nov. 21 to determine whether there is enough evidence to try Borges in Superior Court.

Deputy Public Defender Vicki Carter Briles, Borges’ attorney, said it was too soon to discuss the case because she has just received it.

Borges, a transient, was arrested on Sept. 26, two days after a 12-year-old was abducted while she slept on a sofa of her father’s home.

Huntington Beach police said the girl was raped, then pushed nude from her abductor’s truck near Smokey’s Stables in county territory south of Warner Avenue and Bolsa Chica Street.
