SEAL BEACH : Developer Loses Bid for Suit Dismissal

The Mola Development Corp. has lost an attempt to shake off a suit filed by the Wetlands Restoration Society over a 355-unit residential project.

An Orange County Superior Court judge Wednesday refused to allow Mola to file a request for dismissal of the suit.

In part, the suit, filed last November, contends that the city had no right to approve the project without first updating the city’s general plan. Seal Beach’s general plan, which is supposed to be updated every five years, has not been since 1982.

Jonathan Lehrer-Graiwer, attorney for the Wetlands Restoration Society, said the court is scheduled to hear that case on March 6. Mola’s attorney, Tim Roberts, said he will ask for a continuance on that date.

City officials hope to have completed the new general plan by late February. At that time, it will be submitted to the county for approval.

Once the general plan is returned to the city, officials are required to hold a public hearing on it.
