A 30-year-old sailor accused of infecting a former Navy woman with the AIDS-causing virus will be tried under court-martial proceedings scheduled for Tuesday, Navy officials said Thursday.

Petty Officer John Joseph is charged with assault, aggravated assault and battery in the incident. The woman, a 37-year-old San Diego resident and member of the Naval Reserve, had testified at a hearing this month that she had tested positive for the human immunodeficiency virus after having sexual intercourse with Joseph. Doctors believe the virus, which can be sexually transmitted, causes acquired immune deficiency syndrome.

Joseph neglected to inform the woman that he was a carrier of the virus until after she tested positive, she testified. Had she known, she would not have had sexual intercourse with him, she said.

Joseph declined to comment on the incident before the hearing.

Rear Adm. John W. Adams has reviewed the proceedings from the hearing and referred the case for court-martial proceedings, said spokesman Cmdr. Doug Schamp.
