STATE : Prop. 73 Limits Rejected Again

A federal appeals court refused today to reinstate Proposition 73’s campaign contribution limit of $1,000 from individuals to statewide candidates for the November election.

The U.S. 9th Circuit Court of Appeals voted 2 to 1 to leave in place a federal judge’s order blocking enforcement of key provisions of the 1988 ballot measure.

Judges Cecil Poole and William Norris voted against reinstating Proposition 73, rejecting arguments by legislative sponsors of the measure and the state Fair Political Practices Commission. Judge Charles Wiggins dissented.

The court’s action allows unlimited individual contributions to candidates for governor and other statewide offices until the constitutionality of Proposition 73 is resolved. Limits on legislative contributions remain in place.
