Mayan Club Won’t Appeal $1,112 Award Over Attire

The owner of the trendy Mayan club in downtown Los Angeles won’t appeal a $1,112 damage ruling in favor of four people found to be unfairly excluded from the discotheque because of the way they were dressed.

Sammy Chao, the club’s owner, paid damages to Kenneth Lipton, who brought four small-claims lawsuits against the dance club on behalf of himself and three friends, said Chao’s attorney, Lawrence Nagler. The suit attacked the policy of many nightclubs of allowing inside only those who are dressed a certain way or appear “cool.”

“We feel the decision was dead wrong on the facts and the law,” Nagler said of the Oct. 3 ruling in Lipton’s favor by Municipal Court Commissioner Diana M. Wheatley. “They (the Mayan) just felt that it was best to put it behind them and get on with life and get on with business.”
