NATION : Judge Won’t Bar Bush From War

WASHINGTON — A federal judge today refused a request by 54 Democratic members of Congress for an immediate court order barring President Bush from waging war against Iraq without congressional approval.
Judge Harold Greene held in the 29-page decision that the matter had been brought prematurely, saying the lawsuit did not necessarily reflect the views of a majority in Congress.
Only if a majority of the Congress seek relief from a claimed infringement by Bush on its constitutional powers to declare war could the matter be decided by the court, he ruled.
