California IN BRIEF : SACRAMENTO : Probe Focuses on Appointment

The attorney general is investigating whether Sacramento Superior Court Judge David Stirling can constitutionally serve as chief deputy to Atty. Gen.-elect Dan Lungren, who appointed him to that post earlier this week. Current Chief Deputy Atty. Gen. Nelson Kempsky said the request was made by Gov. George Deukmejian’s legal affairs secretary on behalf of Stirling. The state Constitution specifies that a judge of a court of record is ineligible for public employment or public office other than judicial employment during the term to which he was elected.
