Deputy Fires Shot During Arrest, Then Drops Gun

An undercover sheriff’s deputy wrestling for his gun with one of two suspected heroin dealers fired one shot, then dropped his gun inside their car as he ran alongside, but no one was hurt and both suspects were arrested, authorities said.

Oscar Bautista, 27, and Jose Acuna, 20, were booked on suspicion of assault with a deadly weapon on a peace officer, conspiracy to sell heroin, offering to sell heroin, and taking a firearm from a peace officer.

The incident began about noon Thursday, with the deputy negotiating to buy two balloons filled with heroin from two men in a 1972 Cadillac at 35th Street East and Avenue R in Palmdale, Deputy Rich Erickson said. “At the end of the buy the deputy identified himself and drew his gun,” Erickson said. Bautista, the passenger, grabbed the gun and Acuna started driving away with the deputy running alongside warning him to stop.
