False Advertising by Keyboard Maker Alleged: Grammy-award winning singer-songwriter Don Henley sued Peavey Electronics Corp. over an ad in Keyboard magazine. Henley contends that the ad was false and misleading, and that Peavey violated his right of publicity through the unauthorized use of his name. The ad shows a member of Henley’s touring band at a Peavey keyboard. Henley alleges that the ad uses his name in the text to imply that he endorses the product. Henley seeks an order banning publication of the ad, profits from the sale of the keyboard and $1 million in punitive damages. (Case No. 91-1256. Filed March 7.)
