State Board Gives Doctor Probation in Battery Case

A Torrance doctor has been placed on five years’ probation by state authorities after he pleaded guilty to a misdemeanor charge of sexual battery on a female patient.

The Medical Board of California revoked the license of Gerald Fein, an orthopedic surgeon who was certified in 1968 to practice in the state.

However, the board stayed the revocation and placed Fein on probation with the proviso that he undergo psychological therapy, according to board spokeswoman Janie Cordray.

The board’s action became effective Jan. 25. Fein, who did not admit any wrongdoing before the board, could not be reached for comment.

The disciplinary action against Fein was begun after he pleaded guilty in Municipal Court in 1988 to a battery charge, according to board documents. The battery involved “an unlawful sexual touching” of a patient, the documents state.

Besides successfully completing a treatment program, Fein is required to fully cooperate and make himself available to board investigators monitoring his probation.

Also, a third person must be present when Fein, who lives in Palos Verdes Estates, examines or treats a female patient. The requirement does not apply if the patient does not disrobe and the examination room door remains open.
