Stallone Sued: A boxer-turned-writer whose story served as the basis for the 1959 CBS movie “The Killer Instinct” says that he, and not Sylvester Stallone, provided the basis for the movie “Rocky V.” In a Superior Court lawsuit against Stallone, Joey Barnum says he gave an updated 1989 version of his story to Stallone’s mother and brother, and that it “served as the template for the basic plot, themes and principal characters” of the movie. A Stallone spokesman could not be reached for comment.
