Challenge to Proposition 13

Equal protection under the law and ad valorem taxation are longstanding principles in both federal and California state constitutional law. Proposition 13 denies those basic concepts.

Of course the people have a right to limit taxation. This can be done equitably by putting a cap on the tax rate. Basing the amount of taxes to be paid by a property owner on a date, instead of on the value of the property, is both unfair and unconstitutional.
