San Gabriel : Condo Subdivision Rejected

A proposed commercial condominium project fell victim Tuesday to a new ordinance requiring each unit in such projects to be at least 2,500 square feet.

City Council members cited the ordinance before rejecting 3 to 2 a proposal to subdivide a 33-unit store and office center planned at 200 S. San Gabriel Blvd. Only three of the planned units were large enough to comply with the ordinance.

The action means the shopping center, which was approved in 1990, cannot be divided and sold as separate units.

An attorney for the developers, Tri-tech Associates Co., argued that the new law did not apply because it was passed Dec. 17, four days after the builder had completed its subdivision application.

But City Atty. Robert Kress said the regulation applied because it had been formally proposed by the time the subdivision application was done.

Council members Sabino M. Cici and James Castaneda voted in favor of the project. Cici said it wasn’t fair to the developer to deny the project.
