Mike Tyson’s legal team, headed by Alan M. Dershowitz, are using the reversal of a rape conviction in another Indiana case to argue that their client should be released on bail.
Last week, the Indiana Supreme Court unanimously acquitted Jerry L. Jones, 32, of Indianapolis of raping a woman in 1989, ruling there was insufficient evidence to sustain the conviction. Jones was released Wednesday after serving 15 months of a 20-year sentence.
Dershowitz and Indianapolis attorney Lee B. McTurnan, in a brief filed on Thursday, cited the Jones case in writing that it was “outrageous” for the state to “contend that a year or two in jail pending appeal is merely a ‘collateral’ or ‘incidental’ matter.”
