IRVINE : City Suit Will Go to Court Next Week

The city’s lawsuit challenging an anti-development referendum petition will go to court Tuesday.

Superior Court Judge Mason L. Fenton set the hearing date to allow attorneys for the city and a citizens group to submit further written arguments in the case. The hearing was delayed from its original date of Monday.

The city filed the lawsuit earlier this year in an effort to invalidate a petition circulated by Irvine Citizens Against Overdevelopment. If ruled valid, the petition will require the City Council to overturn its approval last November of the Irvine Co.’s proposed 2,885-home Northwood 5 community or put the project on the ballot.

Fenton probably will rule on the matter later next week.
