Alhambra : No Refund for Flawed Project

A builder whose condominium project was temporarily stopped because of design flaws that were not detected during city approval was denied a request for a refund.

The City Council voted 4-0 Monday to reject Moe Sadeghi’s appeal for $1,595 to cover costs related to the construction of his five-unit condominium project at 821 N. Garfield Ave.

Sadeghi requested $800 as for a safety fence the city installed around the site at his expense and a $795 refund of an application fee for a variance that allows two substandard guest parking spaces. Sadeghi was required to apply for the variance after his initial plans were approved by the Planning Commission.

Michael Martin, acting director of community development, told the council that the construction fence was installed after stop-work orders imposed by Cal/OSHA and the city and that Sadeghi was given prior notice. Addressing the variance, Martin said that the property owner has final responsibility to design and build a project that meets all city codes and conditions.
