LONG BEACH : Judge Rejects Retrial of Former Police Officer

A former Long Beach police sergeant who was acquitted of rape and attempted rape will not be retried on related charges, a Superior Court judge decided this week.

Robert Ballew, who was acquitted this month of sex crime charges stemming from two alleged assaults, will not be retried on charges he kidnaped a woman with intent to commit rape, Judge Clarence Stromwall ruled Wednesday.

The kidnap charge was the only count on which jurors deadlocked on Aug. 13, when they found Ballew not guilty of raping one woman in 1985 and assaulting a second last year. Deputy District Atty. Scott Carbaugh sought to retry Ballew on the kidnaping charge and an false imprisonment charge.
