LOS ANGELES : Homeowners Ask Judge to Allow Gating of Streets
A homeowners group made another attempt Friday to obtain permission to gate streets in its neighborhood, asking a judge to overturn his ruling that public streets may not be sealed off from outsiders.
Los Angeles Superior Court Judge Robert O’Brien ruled in January that the city did not have the authority to take public streets out of public use. He issued a temporary order barring the Whitley Heights Civic Assn. from closing the gates it has erected around the pricey neighborhood east of the Hollywood Bowl.
Citizens Against Gated Enclaves, a group of about 40 homeowners outside Whitley Heights, sued the city a year ago to prevent the gates from being closed, which would have kept them from driving through the area. O’Brien ruled that by giving permission for the gates, the city violated a state law putting public roads under state authority.
O’Brien took the matter under submission.
