Condo Area Liability

Thank you for the informative article in the Sunday, March 14th, Real Estate Section about the recent Court of Appeals decision, which held that condominium unit owners who own the common area of their project in undivided interest can be held personally liable for injuries occurring in the common area.

In the article, I was quoted as having said that trial courts throughout the state will “probably follow” this decision unless another appellate court decides the issue differently.

I should have said that until another appellate court or the state Supreme Court decides the issue differently, trial courts in the state will follow this decision.
