LOS ANGELES : Appeals Court Upholds Liquor Store Crackdown

A state appeals court has upheld the city of Los Angeles’ post-riot crackdown on liquor stores, rejecting an appeal filed by the Korean American Legal Advocacy Foundation on behalf of merchants whose stores suffered damage in 1992.

Responding to a neighborhood outcry, the city imposed conditions on the rebuilding of damaged liquor stores. Merchants filed suit in an attempt to block the regulations that they argued were outside the city’s jurisdiction.

The 2nd District Court of Appeal rejected the merchants’ challenge. The state Department of Alcoholic Beverage Control may be responsible for alcohol regulation, the court said, but cities may impose reasonable limits on land use.
