MALIBU: Civic center property owners have appealed a Superior Court decision upholding a municipal law restricting development, throwing one of the city’s most contentious and costly land-use lawsuits back into court. Allan J. Abshez, attorney for the Malibu Village Civic Assn., a group of 15 civic center landholders who had sued the city to clear the way for a mixed-use residential and commercial project, said the state Court of Appeal will hear the case in six months to a year.

The Malibu Village Civic Assn. sued the city last year, charging that the city’s February, 1993, interim zoning law was invalid because the council did not follow proper procedures in adopting it. The association has been concerned that the ordinance, which outlaws development, would become part of the city’s General Plan, which is due for adoption in November.
