MPS Photographic Sues Card Firm

MPS Photographic Services Inc. in Fountain Valley has filed a lawsuit against Upper Deck Inc. and onetime California Angel third baseman Doug DeCinces, a former president of the sports card company.

The case, filed Tuesday in Orange County Superior Court, alleges that DeCinces and Upper Deck committed fraud and breached a July, 1993, service contract with MPS Photographic.

MPS says it was contracted to supply services including printing, color-processing design and photography. The lawsuit also alleges that the contract was made at a time when DeCinces was negotiating to sell his stake in the company, and further accuses him of never intending to fulfill his part of the contract.

The photo studio said that it provided $75,000 worth of services to Upper Deck, for which it was never reimbursed.

“They did their part and they expect to be paid,” said Steven H. Hertz, a partner in the Anaheim law firm of Moen & Hertz, which is representing MPS. Hertz said MPS is seeking payment from Upper Deck and “if that happens, we don’t need to go any further.”

DeCinces and representatives of Upper Deck could not be reached late Wednesday for comment.
