SIMI VALLEY : Judge Restricts Doctor’s Practice

A Simi Valley cardiologist accused of having sex with a patient to whom he had illegally prescribed drugs was ordered Friday to stop treating women younger than 45 and to stop treating any patients for drug addiction.

The prohibitions issued by Los Angeles Superior Court Judge Joseph R. Kalin were the first disciplinary actions to take effect on Don Alan Lee, who also has an office in Westlake Village.

Lee’s lawyer, Rex Beaber, said his client was pleased with the judge’s decision because it allows the doctor to continue treating the elderly heart patients with whom he now works.

The state medical board, which investigated Lee, ruled in September that the doctor’s license should be revoked effective Dec. 21. A judge Thursday postponed the revocation until Dec. 30, and Friday Kalin granted Lee another month’s reprieve, until Jan. 31.

On that date, Kalin will consider whether Lee’s license should be revoked.

The state medical board found that Lee had sex with Ellen A. Cleary and illegally prescribed her drugs.

Cleary was slain in 1990 after her boyfriend, Timothy J. Velasco, found her in bed with Lee. Velasco was later convicted of first-degree murder.
