MOORPARK : Retired College Dean Loses Labor Suit

A former Moorpark College dean has lost a suit against the Ventura County Community College District claiming that district officials refused to honor an agreement to hire him part-time after he accepted an early retirement.

William Bendat, who worked for the college for more than 22 years, said he was disappointed that the judge who heard the case did not rule in his favor.

But Judge Robert R. Willard said in his ruling that he could not reconcile conflicting testimony between Bendat and then-Moorpark College President Roger Boedecker.

Bendat testified in the monthlong civil trial that Boedecker offered him 400 hours of part-time consulting work at $40 an hour for three years if Bendat agreed to an early retirement.

Boedecker testified that they talked about such an arrangement but that nothing was ever finalized.

In the ruling, Willard said Bendat did not fully prove his case, in which Bendat sought reinstatement to his position as Moorpark College dean or reimbursement for his damages.

Bendat, who retired in 1992, said his pension was reduced by more than 12% because of his early departure.

Attorney Gary P. Jacobs, who represented the college district at trial, was not available for comment Wednesday.
