City Administrator Nelson Oliva, arrested Jan. 28 after a California Highway Patrol officer reported seeing him driving erratically on Interstate 15 in Victorville, will be charged with driving under the influence of alcohol, San Bernardino County prosecutors said.
Authorities also found a plastic bag with 18 grams of cocaine under the driver’s seat of Oliva’s city-owned car, but prosecutors have decided not to file drug possession charges.
Oliva could not be reached for comment. His attorney, Andrew Stein, said authorities “knew he was the wrong man.”
The misdemeanor drunk-driving charge will be filed against Oliva in Victorville Municipal Court next week, Roth said.
