The elder brother of murder suspect John J. Famalaro has been sued on allegations that he sexually assaulted a boy who sought medical treatment from him 16 years ago.

Gregory J. Lambert, now 25, contends in a lawsuit filed Friday in Orange County Superior Court that Warren J. Famalaro, formerly a chiropractor, committed various acts of sexual abuse against him when he was 9 and 10 years old.

The lawsuit also accuses the elder Famalaro of professional negligence and intentionally inflicting emotional distress. It seeks an unspecified amount in general and punitive damages.

Famalaro, 43, lost his chiropractor’s license after he was convicted in 1980 of sexually assaulting two patients, a 10-year-old boy and a 17-year-old girl. According to court documents, he also admitted to a court-appointed psychiatrist that he had sex with two to three patients a year for nearly six years.

Younger brother John J. Famalaro is accused of killing Denise Huber, a 23-year-old waitress, and storing her body in a freezer. Huber disappeared four years ago after her car broke down on the Corona del Mar Freeway in Costa Mesa. Her body was discovered last July at John Famalaro’s Arizona home.

The younger Famalaro is being held without bail in Orange County Jail as he awaits trial, expected to begin next April.
