Eminent Domain May Be Used to Get Parcel

The City Council has voted to use eminent domain if necessary to obtain the property at 4611 La Palma Ave. needed for street widening.

The council, acting in its role as Community Development Commission, on this week unanimously approved a condemnation move against the property after hearing that city offers to buy the land have been refused.

Ismile Noorbaksh, the city’s public works director, told the council that widening La Palma Avenue in the 4600 block is necessary because a city-sponsored affordable housing project is planned nearby. Noorbaksh said the city has made several offers to the landowner, but no agreement could be reached.

The council set a public hearing for 7:30 p.m. Aug. 15 on proposed condemnation of the property. Eminent domain is allowed under state law for property considered vital to the needs of local governments.

From now until Aug. 15, Noorbaksh said, the city will continue efforts to buy the land without using condemnation powers.
