LA PALMA : Condemnation OKd for Street Widening

The city will use its power of eminent domain to obtain a small strip of property needed for the widening of La Palma Avenue.

The City Council, acting as the Community Development Commission, voted unanimously to condemn the property, a strip of land 20 feet wide by 110 feet long facing La Palma Avenue near Denni Street.

The council has said that the land is required for widening La Palma Avenue as part of an affordable-housing project.

The city negotiated for several months with the property owner but was unsuccessful.

The city did not disclose how much it offered for the property.

City Atty. Joel D. Kuperberg told the council: “The redevelopment agency has been more than generous. . . . The city has been careful to do this in a way which is as fair as possible.”

No one representing either the public or the property owner spoke during the brief public hearing.

Kuperberg said Monday that the city will continue to negotiate with the property owner.

If those efforts fail, he said, the matter would go to Orange County Superior Court, where a jury would establish the value of the land.
