Update / * Follow-up on the news : CYPRESS : Regulations for News Racks Are Working

The city is reaching its longtime goal of regulating and reducing the number of news racks, officials said.

In a special report to the City Council, Public Works Director Mark Stoffels said that a new city ordinance governing the placement of news racks is working well.

The council passed the news rack ordinance Jan. 23 and made it effective Aug. 1.

Residents had long complained about the growing number of outdoor newspaper and magazine racks, including many sexually explicit publications, especially in front of the post office.

City Atty. John E. Cavanaugh said that, although the First Amendment prohibits cities from outlawing the publications, the U.S. Supreme Court has allowed cities to regulate the placement of news racks.

Stoffels reported that there were 41 news racks at the post office and 83 overall in the public right of way before Aug. 1. Today, there are 10 at the post office and 32 overall.
