Court Lets Klan Cross Remain on Display

A Ku Klux Klan cross on Fountain Square may remain on display one more day, an appeals court ruled Tuesday.

The court’s ruling was the latest of several defeats for various groups that have attempted to remove privately sponsored religious symbols from public display.

In this case, the City Council had contended that the display constituted “fighting words,” but the U.S. 6th Circuit Court of Appeals disagreed. The display is constitutionally protected free speech and is not a religious issue, the court said.

The Klan had a 10-day permit for the display of the cross, which was erected nine days ago. The cross has been vandalized but was still standing Tuesday.
