Family Appeals Eviction Tied to Sons

A Cabrillo Village family kicked out of its home for the alleged gang actions of two sons has appealed the court ruling upholding the eviction.

Attorney Leonard Chaitin said Court Commissioner Gary K. Barrett’s decision violated the family’s First Amendment rights to free speech.

Cabrillo officials evicted Santiago and Francisca Zizumbo from their federally subsidized home because of the alleged actions of their sons, Edward and Daniel. The two young men are reputed gang members who officials say terrorize the Ventura neighborhood. Terms of the family’s lease allow for eviction if they or any of their tenants are deemed a nuisance to the neighborhood.

But Chaitin said that some of the evidence offered to Barrett--the boys cursing at police--is protected by the First Amendment.
