Family of Boy Hurt in Trash Truck Crash Files Lawsuit

A lawsuit was filed Tuesday against the city of Los Angeles on behalf of an 8-year-old boy who allegedly suffered brain damage after a malfunctioning trash truck slammed into the school bus on which he was riding in December.

The personal injury suit seeks unspecified damages on behalf of Mario Garay and his mother, Rosario Garay. As a result of the accident, Mario suffered a fractured skull and has permanent brain damage, said attorney Steven A. Lerman.

Mario’s cousin, Brian Serrano, was one of two boys killed in the accident, which occurred after a metal rod burst out of the truck and slammed into the school bus. The city is facing two additional suits filed on behalf of the dead boys’ families.

The Times reported Tuesday that a top city supervisor’s notes show that he was ordered by his boss to “back off,” stop being a “crybaby” and “just let things be” after repeatedly complaining about problems with the trash trucks. The notes raise questions whether the city should have heeded the supervisor’s complaints.
