The parents of a 22-year-old man accidentally killed by a ricocheting bullet have filed a wrongful death lawsuit against the man who has been charged with the killing.

Marco Antonio Fuentes was sitting and doing his homework in his garage in Fullerton on Sept. 28 when his neighbor, Eleuterio Ocampo, 67, fired a warning shot at the ground to chase off neighborhood children he believed had thrown fruit stolen from his trees at his house, police said.

The bullet apparently ricocheted off the ground, went through Fuentes’ garage door and struck him in the chest, immediately killing him.

Ocampo has been charged with involuntary manslaughter.

The lawsuit filed in Orange County Superior Court by Catalino and Maria Fuentes seeks unspecified damages.
