Leaving Trash Cans Out Could Lead to Fine

Residents who regularly fail to remove their trash containers from city streets could be ticketed and fined if an ordinance under consideration by city officials is approved.

The policy is designed to complement a pending citywide trash-hauling agreement. Officials will have a public hearing on the so-called Solid Waste Ordinance on Feb. 24 at 7 p.m. in City Council chambers, 211 8th St.

In preliminary discussions about the ordinance Monday night, City Council members said the citations would be issued only to chronic abusers who create an eyesore by leaving their large plastic trash containers on city streets and curbs long after the trash has been hauled away.

“This is a tool we can use to have some sort of enforcement,” Mayor Gwen Forsythe said. “We won’t have a jeep driving around doing garbage patrols.”

City Manager Keith Till said he recommended the ordinance because no laws currently exist making it illegal to leave trash containers on public rights of way. City officials often receive complaints about containers left outside but have no recourse other than implementing public-nuisance laws, he said.
