Grandparents Sued in Drowning

The parents of a Westminster 11-month-old who drowned in a spa have filed suit against the child’s grandparents, the owners of the hot tub, court records show.

Brenden Ogle was alone and unsupervised on Jan. 20, when he drowned in a spa at the Garden Grove home of his grandparents, Patricia and Richard Ogle Sr., according to a wrongful death suit filed this week in Orange County Superior Court.

The suit, filed by Michele and Richard Ogle Jr., seeks unspecified damages for Brenden’s death, and claims the grandparents “knew, or should have known . . . that an 11-month-old, non-swimming infant must be supervised during all waking hours” when near water.

Patricia Ogle said Thursday that she was unaware of the suit, filed Tuesday, and she declined to comment on the civil claim or the drowning. She said she has not spoken to her son or his wife since the days following the tragedy.

“We haven’t heard from them. They won’t talk to us,” Patricia Ogle said.

Neither J. Derek Pakiz, attorney for the plaintiffs, nor his clients could be reached for comment Thursday.
