A judge ruled Friday that South County cities fighting a proposed airport at the El Toro Marine Corps Air Station are entitled to hundreds of pages of preliminary documents prepared by airport planners.

But county officials will have a month to appeal the ruling, said Superior Court Judge H. Warren Siegal.

Opponents of a civilian airport had sought detailed, technical reports prepared by county consultants on whether it would make financial sense to use both John Wayne Airport and El Toro for commercial flights.

“We are very interested in keeping the county accountable in planning for the airport,” said Robert Bower, an attorney for the South County cities.

If the county decides not to appeal, it would be required to turn over the documentation Feb. 27, Bower said.

County Counsel Laurence M. Watson indicated that he will consult with his staff before recommending to the Board of Supervisors whether to appeal.
