Judgment Sought in Suit Seeking Haun’s Annuity
With no response from convicted killer Diana Haun, an attorney is asking that a judge rule as soon as possible on a wrongful death suit filed for the two young sons of her victim, Sherri Dally.
Oxnard attorney John Malmo said Friday that Haun has not responded to a lawsuit filed in December and said he had asked for a judgment in the case. He said a judge could award damages in the case within a month.
Convicted last fall of killing the Ventura homemaker, Haun is now serving a life sentence. Haun’s lover, Michael Dally, is on trial, accused of plotting his wife’s death.
Malmo is seeking money for the two boys, Devon Michael Dally, 9, and Max Anthony Dally, 8.
“They’ve been deprived of their mother,” Malmo said. “No one can bring their mother back. Sherri is dead. This is the best we can do to compensate for the loss.”
Malmo is targeting an annuity Haun receives as part of a settlement she received after being hit on the head by a basketball backboard in high school. It is worth nearly $1 million over the next 25 years.
The two boys live in Ventura with Michael Dally’s parents.
