Curfew Is Amended to Make It More Specific

The city has amended its nighttime curfew in response to a recent San Diego court case in which a similar ordinance was dismissed as too vague.

The changes, which were given final approval by the City Council on Tuesday, will make Brea’s ordinance more specific and help it stand up to court challenges, officials said.

However, the amendments will not significantly alter the substance of the law or the way in which it is applied, Police Capt. Chester H. Panique said.

Brea imposes a curfew between 10 p.m. and sunrise for anyone under 18, with certain exceptions that include the exercise of 1st Amendment rights.
