Accused Homeowner May Face Fewer Charges

The city attorney’s office is considering reducing the number of charges it brings against Elena Zagustin as the trial of the Huntington Harbour homeowner begins today.

Zagustin, 61, faces 92 misdemeanor charges for allowing her home to pose a health and safety threat to others.

The city conducted several inspections of her home during the last five months and determined her dwelling did not meet city codes.

Residents have also been involved in a decade-long battle with Zagustin because of the conditions at her home. Residents succeeded in winning close to $300,000 in civil court cases.

Deputy City Atty. Jennifer McGrath said that reducing the number of criminal counts might speed up the trial.

“Some charges are not as strong as others,” she said. “But the reduction will not significantly reduce the number of charges nor the intent of the city.”

If convicted, Zagustin could face a $500 fine and six months in jail on each count.

City officials have said their goal is to have her comply with city codes.

The trial begins today at 8:30 a.m. at Municipal Court, 8141 13th St., in Westminster.
