Judge Delays Trial on House’s Condition
A judge Thursday postponed the trial of a Huntington Harbour woman accused of neglecting her home until an appellate court decides whether a search of her property was legal.
Elena Zagustin, 61, is charged with 95 misdemeanor city code violations for alleged health and safety threats to her neighbors, who have waged a years-long legal battle against her property.
City officials have conducted three inspections on the Morse Circle home since November, citing violations including unsanitary conditions and improper use of extension cords.
They ordered her to vacate the home after determining she lacked hot or cold water. If she reestablishes running water, Zagustin could be allowed to return.
Zagustin, a Cal State Long Beach professor, contends officials illegally searched her home Nov. 20. She filed an appeal last month after Orange County Municipal Court Judge David Thompson denied her motion to dismiss evidence gathered in the search.
Municipal Judge Thomas J. Borris said he would delay the trial for 60 days until the appeal is decided.
Zagustin walked out of the courtroom without comment. If convicted, she could face a $500 fine and six months in jail on each count.
