The nation’s largest record conglomerates have won the first round in a lawsuit against the maker of a hand-held device that can download and play back pirated songs from the Internet. A federal judge issued a temporary restraining order against Diamond Multimedia Systems Inc., preventing the company from releasing its Rio portable MP3 player. The Recording Assn. of America, a Washington trade group representing the music industry’s six major companies, filed suit against San Jose-based Diamond last week, accusing it of violating the 1992 Digital Audio Home Recording Act.
