Re “Gov. Davis Should Do the Right Thing on Prop. 187,” Commentary, April 2: Douglas Kmiec’s twisted logic is that in spite of the fact that 60% of California voters supported Prop. 187, Gov. Gray Davis should drop the appeal. He feels that if the majority vote disregards the Constitution, it should be overturned.

The question really is, who decides if it disregards the Constitution? Is it a handpicked liberal judge chosen by opponents of 187? Or is it the Supreme Court? If Gov. Davis continues the appeal, he is asking the Supreme Court to make the decision, not a single judge with a shared ideology of opponents of this measure.

In spite of his twisted attempt to support his opinion by quoting Hamilton’s Federalist Paper No. 78, Kmiec would like Davis to drop the appeal based on Kmiec’s arguments. Frankly, I’d prefer to hear from the Supreme Court.
