Regis Construction Settles Defect Suit for $8.4 Million

Regis Construction Co. of Irvine has agreed to pay a Ventura County community association $8.4 million to repair defects at the Shadow Ridge at Oak Park complex.

The settlement was announced Thursday. An Orange County Superior Court judge was expected to ratify it today.

According to their 1997 lawsuit, Shadow Ridge’s 440 condominium owners had a litany of complaints, from leaky windows, doors, roofs and decks to plumbing and electrical problems.

“There were pretty chronic leaks, and when you have standing water, you get rotting, seepage and other problems,” said association President Gerald Kline. “This is exactly what we needed to bring the community up to standard.”

The association will use the money to repair water damage and to install adequate protection between units to prevent fires from spreading, said Thomas Miller, the group’s attorney.

Regis did not admit liability in the settlement, said the builder’s attorney, Richard Glucksman.

“The company pursued a settlement to avoid the cost of litigation, and it will be paid primarily by the subcontractors,” Glucksman said.

Miller said the settlement is the second-largest in a Ventura County construction-defect case, yielding more than $19,000 per unit.
