City Council members will discuss in closed session Monday a lawsuit served against them by the Lake Mission Viejo Assn.
The lawsuit claims a city ordinance unfairly discriminates against the lake by imposing landscaping requirements affecting association property only.
The ordinance calls for the trees and vegetation along an 800-foot stretch of Alicia Parkway to be trimmed to 18 inches to keep the view open to all members of the community. It was passed following a 1997 lawsuit filed by the association against the city.
Despite the most recent lawsuit, the city has posted ordinance violation notices on lake property, said board president Jeff Miklaus.
“It’s typical of their arrogance that they posted the notices on our property before they even told us we were in violation,” he said.
City Manager Dan Joseph said the city likely will defend its ordinance in court.
