The city is studying whether to make any changes to its 1994 ordinance on news racks. The ordinance regulates the location of the racks for dispensing newspapers and other publications, and requires the display and content to comply with laws about the sale of “harmful matter.” The city attorney is researching whether the city can prohibit a certain publication from being sold in news racks, restrict the number of locations of the racks and prohibit them from being located near schools or churches. The attorney also will look into whether the city can require all news racks to be a specific color, size or shape and to what extent the city-collected fees can be used to regulate news racks.
