Arrested after jumping a commuter train turnstile, Martin L. King was shackled and taken to the brig at Camp Lejeune, N.C., charged with deserting the Marines.

King said he told authorities they had the wrong man; he’d never been in the military. Still, he was held for 40 days, during which he claims he was sexually assaulted by another inmate.

King, 33, is suing the Marines and the U.S. government for unspecified damages. The suit is awaiting a trial date.

Marine Corps officials confirmed King was in the brig from Aug. 23 to Sept. 13, 1996, but declined to comment further.
