Hate-Crime Assault Earns Man 37-Month Prison Term

A former Orange resident was sentenced to 37 months in prison Friday, ending the first federal prosecution of a hate-crime assault in Orange County.

Kevin Timothy Dale, 23, could have received up to 10 years in federal prison after pleading guilty in January to charges that he helped beat another man unconscious after a punk-rock concert in Orange in 1995.

Dale admitted in court that he had jumped from the top of a car onto Mark Sanjay David, now 29, as part of a crowd of 10 to 15 white youths who attacked David because of his Asian ancestry. David is of Indian descent.

David suffered a fractured skull and other injuries in the attack, but survived.

Before he was sentenced by U.S. District Court Judge David. O. Carter, Dale apologized for his role in the attack, said Michael Gennaco, chief of the U.S. attorney’s civil rights section in Los Angeles.
