City officials have denied a claim from a Brea police motorcycle officer who lost his left leg in an accident on Yorba Linda Boulevard in November.

Tom Bischetsrieder, 41, a nine-year veteran of the department, which also serves Yorba Linda, was injured when his police motorcycle crashed into a small sport utility vehicle that was coming out of a driveway. Officials said Bischetsrieder, currently on paid leave, will return to work in a few months.

“There was a dangerous condition in the roadway,” said Shale Krepack, the attorney representing Bischetsrieder. “The city was aware of it and didn’t correct it. It’s too obvious that the city has been negligent.”

City Atty. Leonard Hampel said the city had to reject Bischetsrieder’s claim because the damages listed were “continuing and incomplete.”
