‘Attractive Nuisance’
* Law school professor Peter Reich (letter, Nov. 7) suggests that the INS is responsible for migrant deaths by “forcing migrants across rural areas.” (This is because the easier routes are now better guarded.) He invokes the legal concept of “attractive nuisance.”
By that same logic if I lock my house to protect my possessions and an intruder breaks his neck during a midnight second-story break-in, I am responsible! If this kind of theory is taken seriously perhaps all the lawyer jokes are justified.
